§ 1 Acceptance of the Terms of service and purchase agreements
By completing the order (confirming the order by clicking the “Buy now” button in the checkout area), the buyer confirms that they have read and accept our Terms of service and purchase agreement as described here. The buyer has the opportunity to read these at any time during the ordering process via a link.
§ 2 Order/Conclusion of Contract
2.1 The offers in our online boutique constitute a non-binding invitation to you to purchase works of art. The works of art are offered subject to availability in the boutique.
After entering your data and clicking on the purchase button in the checkout area of the shop, you submit a binding offer to conclude a purchase contract.
The contractual partners are the buyer of the artwork and the artist who created it (hereinafter referred to as the seller).
2.2 The purchase contracts concluded via our shop are therefore concluded directly between the buyer and the seller.
2.3 The confirmation of receipt of the order, which is sent immediately by email, also constitutes the seller's acceptance of the offer (subject to the availability of the artwork). The final purchase contract is concluded with the confirmation of this availability by email within 7 working days of the order being placed. If the artwork is no longer available in the meantime, this will result in the cancellation of the order. If the purchase price has already been paid, the seller will refund it to the buyer immediately and without being asked. However, the artworks shown in the online shop are usually also available for purchase.
§ 3 Main obligations
3.1 The artist, who is the author of the work, is obliged to transfer to the buyer the ownership rights to the above-mentioned work. The sale does not include the transfer of rights of use (for e.g. any type of reproduction, print or online distribution, profitable public display, etc.).
3.2 Photos or videos of spaces in which the artwork appears in the image, showing more of the space and surroundings than the artwork itself (e.g., interior design photos or film footage of interiors), may be published. In this case, the artist shall be informed of the publication at the earliest opportunity, with precise details of when and in which media the publication will take place.
§ 3 Payment and due date of the payment
4.1 The purchase prices shown on this website do not include delivery of the artwork, nor delivery insurance of the artwork.
4.2 Payment for the purchase shall be made in the amount of the gross sales price (including VAT) of the ordered artworks as shown in the shop and in accordance with the selected payment method.
4.3 If the buyer wishes to look at the artwork before making a purchase, an appointment at artist studio is available with appointment, requested at hello (a) katja-anina.com.
4.3 The purchase price is payable immediately from the date of sale with a payment deadline of 14 days. Transfer fees are to be carried by the buyer. Until full payment has been made, it remains the property of the artist. The artwork can only be picked-up by the buyer after the payment has been done and the artist has received the full payment. If a later than here agreed payment is made, possible additional costs of insurance, storage or suspended delivery due to the late payment must be fully covered by the buyer.
§ 4 Delivery
4.1 The ordered goods purchased with a shipping option will be delivered to the buyer's address specified in the order form in accordance with the delivery terms applicable to the respective artwork.
4.2 The shipping fee includes a delivery insurance. Unpacking the artwork, setting up the artwork, and any moment after the delivery of the artwork is in full responsibility of the buyer.
4.3 For purchases from abroad and deliveries abroad, especially to countries outside European Union, additional customs duties, taxes, fees, and similar costs may apply, which are not included in the prices shown, nor in the delivery fee, and must be borne by the customer. The customer must obtain the relevant information, e.g., from the local customs authorities.
§ 5 Return policy
5.1. Return policy for ready-to-order fine art prints:
Return and refund policy is only available for ready-to-order fine art prints and large number editions:
• Returns accepted for 14 days
• Customer provides return shipping, return shipping art insurance and packaging
5.2 Return policy for custom order, unique and customized editions, oil paintings, commissions:
Custom orders, customized and unique small number editions especially made for one exhibition, commissions and oil paintings are not refunded. The client has the option to come by the artist studio or at the exhibition to look at the artwork with detail and care and receive all information about the artwork the client wishes to acquire before making the purchase.
If the client is undecided about an artwork or its matching capability inside his/her/their space, options to short-time-renting or leasing of an artwork are available. Please contact the artist at hello (a) katja-anina.com to find out more about renting or leasing an artwork.
§ 6 Right of exhibition
6.1. The buyer is entitled to exhibit the work as public event only with the written consent of the artist.
§ 7 Storage of your order data
We store your order with details of the contract concluded (e.g., type of artwork purchased, price, etc.) solely for the purpose of correctly processing your order. However, we will send you a summary of your order in an invoice with the email confirming receipt of your purchase offer. You can also access the Terms of service and purchase agreement at any time via our website. If you wish to save your purchase on our shop page for your own purposes at the time of ordering, you can, for example, take a screenshot (= screen photograph) of your shopping cart in the checkout area or, alternatively, print out the entire page.
We undertake to keep the personal data collected during the ordering process confidential. This data will not be passed on to third parties at any time, except to the deliver and delivery insurance parties.
§ 5 Final clauses
Any amendments to this contract must be made in writing. The place of jurisdiction is Luxembourg.
